Please read these terms and other policies carefully. By using Hola or signing up for an account, you’re agreeing to these Terms and Conditions. This is a legal agreement.

For the purpose of the terms and other policies we may refer to Hola and/or its services as “Hola”, “Hola Enterprises”, “Hola Services” or “us” and the client as customer” or “you”.


Eligibility Criteria

To start using the services offered by Hola Enterprises, you must:

  1. Be at least 18 years old
  2. Be able to enter into contracts
  3. Complete the registration process;
  4. Agree to the terms as mentioned in this section; and
  5. Provide true, complete, and up-to-date contact information. 

By using any services offered by Hola Enterprises, you represent and warrant that you meet the criteria mentioned above, and that you will not use Hola services in any way that violates any laws or regulations.

The above criteria may be updated at any time by Hola Enterprises. We also reserve the right to change our services or any feature of the services at any time. Any such change will be updated on the website and/or notification will be sent to your last registered email address with us. The modified policy will come into effect 10 days from the update and notification. In case you do not wish to continue Hola Services please initiate the termination of your account by writing to us from your registered email id.


General Rules

When using Hola Services you are responsible to abide by the following rules:

  1. You will not violate our policies as mentioned in this Agreement.
  2. If you use our API, you’ll comply with our API Use Policy given below.
  3. In case of violation any of these rules, we reserve the right to suspend or terminate your account.


Term

The Term begins when you sign up for Hola and continues as long as you use the Service. If you sign up for Hola on behalf of an Enterprise or other entity, you represent and warrant that you have the authority to accept these Terms on their behalf.

Cancellation & Refund Policy

Hola Enterprises reserves the right to refuse service, close accounts of any users at any time at our sole discretion.

For any reason if you wish to close your account with Hola, you may do so by sending us an email from your registered email id. To avoid incurring any recurring costs it is advisable to follow the proper procedure and ensure proper closure of your account and termination of this contract. 


Refunds

No refunds are provided in case the agreement is terminated by the user. However, in case Hola terminates the contract you would be provided with the prorated amount, provided the termination did not happen due to violation of our policies.

In any of the cases, your purchased cards would be delivered till the card limit is reached or the subscription expires.


Expiry

Based on the type of subscription you registered for, the account would expire and lapse. Hola Enterprise is not responsible for any consequences of the discontinuity. Also the Holacards sent would be available for a period of 45 days after the subscription expiry on our server and would be deleted after that. This period is subject to change, at the sole discretion of Hola Enterprise. However, you would be sent alerts via email to your registered email ID about the expiry and you are expected to extend your subscription to keep your cards live.


Payment Changes

We may change our fees at any time by posting a new pricing structure to our Website and/or sending you a notification by email. If the fees structure changes, your current plan will continue till expiration and/or you will be provided with an option to upgrade .


Limitation of Liability

To the maximum extent permitted by law, you assume full responsibility for any loss that results from your use of the Website and the Services, including any downloads from the Website. We and our Team would not be liable for any indirect, punitive, special, or consequential damages under any circumstances, even if they are based on negligence or we have been advised of the possibility of those damages. Our total liability for all claims made about the Service in any month will be no more than $1000

We and our Team are not responsible for the behavior and actions of any advertisers, linked websites, or other Members.


Rights

Proprietary Rights Owned by Us

You shall respect our proprietary rights in the Website and the software used to provide Hola services (proprietary rights include patents, trademarks, service marks, and copyrights). You may only use our brand assets according to our Brand Guidelines.

Proprietary Rights Owned by You

You represent and warrant that you either own or have permission to use all of   material in your Emails. You retain ownership of the materials you upload to Hola and will make sure that you will not upload any un-authorised or harmful content. We may use or disclose your materials only as we describe in these Terms and our Privacy Policy.


Indemnification

To the extent authorized by law, you agree to indemnify and hold harmless Abda Digital Private Limited, its employees, officers, directors, affiliates, and agents from and against any and all claims, losses, expenses, damages, and costs, including reasonable attorneys fees, resulting directly or indirectly from or arising out of (a) your violation of the Terms, (b) your use of any of the Services, and/or (c) the Content you make available on any of the Services.

 

Delivery Policy

Hola Enterprises assures quality and timely delivery of its services as the services are designed. The clients can start using Hola Services once the payment as agreed in the contract has been made. ​API Use Policy

API Use

Hola Enterprises has open REST APIs. The APIs make it possible fordevelopers to better use the Services and build integrations that help other people use the Services in new ways (each an “Integration”). We provide theseAPIs to allow people to build on and benefit from Hola Enterprises platform. At the same time, we have to protect our system, as well as our users’ rights.  Your use of the APIs must comply with both this Policy and our Terms of Use.  

Login

You’ll only access the API using an API key. If you have an Integration, then   must have the option to log using their API key. You won’t prompt users to provide their username, password, or security questions.


Spam and Abuse

You won’t use the API to send spam or, if you’re using API, take any actions that violate our Terms and Conditions, and Privacy Policy. You’ll follow all documentation we provide for the APIs. You won’t attempt to hack or change the way the Services function. We may throttle your use of the APIs at any time. We may monitor your use of the APIs for compliance with these rules, and we may deny You access to the API or shut down your Integration if you try to go around or exceed the limitations we set.


Privacy

You’ll respect the privacy of our users. Your Integration must display a privacy policy for users, detailing the information you’ll collect from them when they use the Integration.


Ownership

We own all worldwide rights, titles, and interest in the Services and the APIs, including all intellectual property rights, marks, code, and features. You won’t infringe or copy our code, design, or content. Any rights not expressly granted by this policy are withheld, so if you don’t see it here, then it’s not a right we’re giving you. You own all worldwide rights, titles, and interest in the Integration, except for the APIs, our marks, and the Services, including all intellectual property rights. If you give us comments about the APIs or the Services, we may copy, modify, create derivative works, display, disclose, distribute, and use that feedback without any obligation to compensate you.


Use of Marks

You may only use our name and marks (meaning our logos, word marks and copyrighted images) after taking our consent.

 

Representations and Warranties

You represent and warrant that you’ll maintain all the licenses required for your Integration, and that your Integration won’t violate any law or regulations in any way.


Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HOLA ENTERPRISES OFFERS THE SERVICES (INCLUDING ALL CONTENT AVAILABLE ON OR THROUGH THE SERVICES) AS-IS AND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING THE SERVICES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. HOLA ENTERPRISES DOES NOT WARRANT THAT THE FUNCTIONS OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT CONTENT MADE AVAILABLE ON OR THROUGH THE SERVICES WILL BE ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY SERVERS USED BY HOLA ENTERPRISES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. HOLA ENTERPRISES DOES NOT WARRANT OR MAKE ANY REPRESENTATION REGARDING USE OF THE CONTENT AVAILABLE THROUGH THE SERVICES IN TERMS OF ACCURACY, RELIABILITY, OR OTHERWISE.


Updates

We may update or modify the APIs and this Policy from time to time by posting the changes on this site or notifying you via email. These changes may affect your use of the APIs or the way your Integration interacts with the API. If we make a change that’s unacceptable to you, you should stop using the APIs. Continued use of the APIs means you accept the    .


Confidentiality

You may have access to confidential, proprietary, and non-public information specific to the APIs (“Confidential Information”). You may use this information only to use and build with the APIs. You won’t disclose the Confidential Information to anyone without our written consent, and you’ll protect the Confidential Information from unauthorized use and disclosure in the same way you’d protect your own confidential information.Indemnification

Miscellaneous Terms

This policy is part of our Terms & Conditions. The parties agree that no joint venture, partnership, employment, or agency relationship exists between you and Hola Enterprises as a result of the Terms or from your use of any of the Services.

Personal Information


When you register for our services some information is captured for the sole purpose of providing our services.

The information you submit at our website (www.holaenterprises.com) may include your Name, address, IP address, email address, credit card information, and other details. We may also capture and store information regarding your actions in our application. We may also track the activities through any emails sent from our application. We may also get some information from social media websites.

We do not use your information for any other purposes. We do not sell, rent, lease or trade your information to any individual or organization for any purpose.


Your Distribution List

To use our services you may add distribution lists with email addresses, names and other information for your vendors, employees and clients. We do not share, sell, lease, rent or trade any part of your lists to any individual or organization. We do not use the information in your lists to send any marketing messages.


Email Content

The campaigns sent out through our application would likely go through various servers before reaching the intended recipient. It is advisable not to send any confidential information in the campaigns.


Cookies

Cookies are string of codes on your computer used to collect information on your activities on our application and other information like your browser type. We may use cookies on your computer and you may turn them off using your browser settings.


Account Details

It is your responsibility to maintain the confidentiality of your account/username and password. It is also your responsibility to inform us of any unauthorized use of your account by calling Customer Care at or sending an email to . You’re responsible for keeping your account name and password confidential. We are not responsible for any losses due to stolen or hacked passwords. We do not have access to your current password, and for security reasons, we may only reset your password.
